Generator Permits in Lee County: Placement and Permit Planning Before You Choose Equipment

Generator permits in Lee County are not one process but seven: unincorporated Lee County and six cities each issue their own, and the same house can sit in a flood zone that adds a floodplain review on top. Choosing a generator before you know who issues the permit, where the unit can legally sit and whether the lot is in a Special Flood Hazard Area is how projects get redesigned twice. This guide lays out the questions to settle first, with the official source for each.

01

Generator permits in Lee County: identify the authority for your property

Lee County’s Building & Permitting Services issues permits only for unincorporated areas such as Lehigh Acres, North Fort Myers, San Carlos Park and Pine Island. Inside city limits, the city is the authority: Cape Coral’s Permitting Services Division, the City of Fort Myers Community Development department, Bonita Springs, the Village of Estero, Sanibel and the Town of Fort Myers Beach. A Fort Myers mailing address does not mean the City of Fort Myers; large parts of what people call Fort Myers are unincorporated county. Confirm the jurisdiction on the county property appraiser’s record or by calling the office before anything is drawn. Each office has its own application, review times and inspection scheduling, and the Florida Building Code, 8th Edition (2023), is the base code for all of them.

The site plan: what the reviewer needs to see

Every office starts from a site plan. It shows the house, property lines, easements and setbacks, the generator pad, the transfer switch, the gas meter or propane tank and the route of the gas and electrical lines. The clearances between the generator and the house, windows, doors and vents are not a universal number you can look up online; they come from the installation manual of the specific model and from NFPA 37, the standard for stationary combustion engines, as adopted by the Florida Building Code. The reviewer checks that the drawing meets the manual, and the inspector measures it on site. Lot shape decides a lot in Lee County: a Cape Coral canal lot with a seawall, a zero-lot-line villa in Estero and a half-acre in Alva each push the unit to a different side of the house.

  • Generator pad location, with the model’s clearances from the installation manual drawn to scale
  • Transfer switch position next to the main panel or service entrance
  • Gas meter or propane tank, with the line route and the shut-off
  • Property lines, easements, drainage swales and setbacks
  • Service access: a technician needs to open the enclosure on the service sides

Fuel and transfer equipment

Three trades meet in a generator permit: electrical, gas and sometimes structural. The electrical side covers the automatic transfer switch, its rating against your service and any load management. The gas side covers either a new or upsized natural gas meter and the piping to the unit, or a propane tank: its size, whether it is above ground or buried, and its own setbacks from the house, property lines and sources of ignition under NFPA 58. Propane tanks in flood zones need anchoring, which the floodplain reviewer looks for. If the unit is going on an elevated platform, the platform is a structure of its own with wind-load and anchoring requirements. Gen-Power’s assessment produces one drawing set covering all three so the offices are reviewing the same project.

Floodplain review

Much of Lee County is in a FEMA Special Flood Hazard Area, and after Ian the question is no longer abstract. Lee County’s Floodplain Management office requires permits for work on structures in the SFHA and uses the base flood elevation on the FEMA map to decide how high equipment must sit; an elevation certificate documents it. That is why you see generators on elevated aluminum stands or concrete platforms along the coast from Fort Myers Beach to Bokeelia. The county has also announced revised flood maps taking effect on March 2, 2027, so a lot that is outside the SFHA today may not be next year, or the required elevation may change. Check the current and preliminary maps at the FEMA Flood Map Service Center before you commit to a pad at grade. The cities run their own floodplain reviews under the same federal framework.

05

HOA approval versus the permit

If the house is in an association, the architectural committee reviews the same drawing for different reasons: appearance, screening and location rules in the governing documents. Florida’s section 720.3035 now treats exterior fixed generators and fuel tanks as hurricane protection and limits an HOA’s ability to deny a conforming application, but it does not touch the building permit. Keep both tracks on the same drawing set and do not pour a pad until both have answered.

06

What the technical assessment settles

A Gen-Power assessment visit answers the placement and permit questions before a model is chosen: jurisdiction, flood zone and required elevation, the side of the house that meets the manual’s clearances, the fuel source and its route, the transfer switch location and the loads you want covered. The result is a drawing set and an installed quote that already reflect the permit requirements for your address, rather than a generic price that changes once the reviewer comments. Call (239) 674-3569 with your address, or request a call back, and we will tell you which office will review your project and what the floodplain map says about your lot.

LET’S MAKE IT CLEAR

Frequently asked questions about standby generators in Southwest Florida

A clear plan starts with answers you can use.

Ask our team
Do I need a permit to install a standby generator in Lee County?

Yes. A permanently installed generator involves electrical and gas work regulated by the Florida Building Code, so the county or the city where the house sits issues a permit and inspects the work. Portable generators are not covered by this guide.

Who issues the permit: Lee County or my city?

Lee County only permits unincorporated areas. Cape Coral, Fort Myers, Bonita Springs, Estero, Sanibel and Fort Myers Beach issue their own. Confirm the jurisdiction from the property record, since a Fort Myers address is often unincorporated county.

How far from the house does a generator have to be?

The clearances come from the installation manual of the specific model and from NFPA 37 as adopted in the Florida Building Code, and the inspector measures them on site. There is no single distance for every model and every wall, which is why the site plan is drawn per property.

Does my generator have to be elevated in a flood zone?

In a Special Flood Hazard Area the floodplain reviewer compares the equipment height with the base flood elevation on the FEMA map, which can require an elevated stand or platform. An elevation certificate documents the result.

Does HOA approval replace the permit?

No. They are separate reviews of the same drawings; you need both before installation.
